On 25 October 2022, Council considered submissions received to the proposed Austral Avenue, Upwey – Road Improvement Works Special Charge Scheme, and resolved to proceed with the declaration of the special charge, without modification.

In accordance with the provisions of the Local Government Act 1989, Formal Notices advising landowners of Council’s declaration and their liability for the proposed Special Charge for Austral Avenue, Upwey - Road Improvement Works have been sent. This formal notice is served on all owners of properties within the designated area of the scheme, being properties that abut or gain primary access via Austral Avenue, Upwey.

The Notice includes information relating to the Special Charge Scheme, the estimated cost apportioned to the property, and advises that if you are aggrieved by Council’s imposition of the Special Charge you may apply to the Victorian Civil and Administrative Tribunal for a review of that decision.

The Victorian Civil and Administrative Tribunal must receive appeals in relation to Section 185 of the Local Government Act within 30 days after the date of effective service of the notice.
