Declaration of Special Charge

On Day Month Year, Council considered submissions received to the proposed Boronia Road, Parts Sylvan Avenue and Unity Court, Warburton – Road Improvement Works Special Charge Scheme, and resolved to proceed with the declaration of the special charge, with modification.

In accordance with the provisions of the Local Government Act 1989, Formal Notices advising landowners of Council’s declaration and their liability for the proposed Special Charge for Boronia Road, Parts Sylvan Avenue and Unity Court, Warburton - Road Improvement Works have been sent. The formal notice is served on all owners of properties within the designated area of the scheme, being properties that abut or gain primary access via Boronia Road, Parts Sylvan Avenue and Unity Court, Warburton.

The Notice includes information relating to the Special Charge Scheme, the estimated cost apportioned to the property, and advises that if you are aggrieved by Council’s imposition of the Special Charge you may apply to the Victorian Civil and Administrative Tribunal for a review of that decision.

The Victorian Civil and Administrative Tribunal must receive appeals in relation to Section 185 of the Local Government Act within 30 days after the date of effective service of the notice.

Next step by Council
Council must now wait for advice from the Victorian Civil and Administrative Tribunal as to whether an appeal has been lodged to the proposed scheme. If an appeal is lodged, the Victorian Civil and Administrative Tribunal will then set a date at which the matter will be considered and a decision will be made as to whether the scheme will continue and, if so, with or without modification.

If no appeals are lodged, then the scheme will proceed with tenders being advertised for construction of the works.
